*Negotiated on a project by project basis based upon customer requirement.
Cost of installation is not to exceed commercial practice plus 1%
for the Industrial Funding Fee.
Discount accepted by the government:
$0 - $10,000 list price - 48% $10,000 & over list price - 53%
which includes the industrial funding percentage, and is applied
from Mobile Media, Inc.'s Carriage, Component & L&T Shelving
pricelist dated April 24, 1996.
FOB Terms 2% - 10 days, Net 30 days
Delivery terms: 30 - 45 days ARO

Minimum Order: $500
Maximum Order: $200,000
Volume Discount: None
Warranty: Mobile Media's Lifetime Warranty as submitted
applies to all orders placed under this contract.
Returns: Returns will not be accepted without prior
written approval by Mobile Media, Inc. All products are manufactured
specifically to order. Returns are not allowed for the purpose of
restocking upon payment of restocking fee.
Cancellation: There will be no cancellation charge
if an order is cancelled prior to being scheduled for production.
Once an order has been scheduled for production no changes, to include
cancellation, may be made without written authorization from Mobile
Media, Inc. If an order is cancelled after production has begun,
the government will only be charged for the actual cost incurred
for the items which cannot be resold within six months from the
date of cancellation.

Price Reduction: In accordanced
with clause 552.238-76, entitled "Price Reduction" , the
category of customer on which this award is predicated will be Mobile
Media Inc.`s dealers who receive a basic discount of 55% for projects
less than $10,000 list & 60% for projects greater than $10,000
list from Mobile Media Inc.`s commercial pricelist dated 4-24-96.
The government receives a basic discount of 48% for orders under
$10,000 & 53% for orders over $10,000 inclusive of industrial
funding. The discount to the government 48% for orders under $10,000
& 53% for orders over $10,000 includes (allows) 8% markup for
dealers services and 3% for freight. This relationship between Mobile
Media and the government shall be maintained throughout the contract
period. Any change in the contractor`s commercial pricing arrangement
with their dealers, which disturbs this relationship will constitute
a price reduction.
Not withstanding the
above provision, the contractor shall report all price reductions
to dealers along with an explanation of the conditions under which
the reductions were made.
The Company will accept
the Government Credit Card.

DEALER AGREEMENT
1. Mobile Media, Inc. holds this contract and all PO’s &
payments must be made to Mobile Media, Inc. The dealer may be authorized
as representing Mobile Media for said GSA transactions.
2. Dealer will be commissioned 12% on selling price of materials
sold under SIN 711-5.
3. Dealers are not commissioned on installation sold under SIN 711-95
when installed by Mobile Media personnel unless agreed before submission.
4. Dealer will be reimbursed full installation price less 1% industrial
funding fee when installed by dealer.
5. No commission is paid on Open Market Items supplied by Mobile
Media.
6. Dealer is reimbursed in full for any Open Market Items supplied
by the dealer. |
